This role involves leading a team that oversees and examines financial firms in the derivatives market to ensure they follow rules on money handling, reporting, and fair practices, protecting investors and maintaining market stability.

Full Job Description

The Market Participants Division (MPD) leads the Commodity Futures Trading Commission's efforts in protecting market participants and their funds by ensuring the financial integrity, fitness, and fair business conduct of derivatives market participants, such as swap dealers (SDs), major swap participants, futures commission merchants (FCMs), introducing brokers, commodity pool operators, commodity trading advisors, floor brokers, and retail foreign exchange dealers futures associations.

CT-16 Level: To qualify for the CT-16 level you must have at least one year of specialized experience equivalent to the next lower grade (GS/CT-15 level).

Specialized experience is defined as that through which one has gained experience applying accounting, auditing, regulatory compliance, risk management and related concepts, practices and procedures in order to manage an examination program.

This specialized experience includes oversight, management, and conduct of a wide range of financial surveillance activities including directing the work of others.

In addition, you must show that you possess the Executive Core Competencies (ECCs) and Mandatory Technical Qualifications (MTQs) related to this position within your resume - NOT TO EXCEED 2 PAGES.

MANDATORY TECHNICAL QUALIFICATIONS (MTQs): Your resume should demonstrate accomplishments that would satisfy the technical qualification.

MTQ 1: Experience leading an examination program involving the oversight of financial institutions' compliance with regulatory obligations including financial and reporting obligations.

Particular experience assessing an entity's compliance with financial (including capital), financial reporting, recordkeeping, business conduct, and other compliance obligations.

MTQ 2: Experience providing technical expertise in the development of rules, regulations and compliance standards.

Current Members of the SES, those that have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, MUST ensure the CFTC's ECCs are demonstrated within their experience and accomplishments.

Proof of eligibility for a noncompetitive SES appointment (e.g., SF-50, Certification by OPM's SES Qualifications Review Board (QRB)) will not be accepted.

As an executive at the Commission, the incumbent serves as a key member of the agency's leadership team and is responsible for directing one or more key programs, advising the agency on policymaking, and collaborating across organizational lines on agency-wide issues.

As the Deputy Director for Examinations in the Division, the incumbent serves as a consultant and principal advisor to the Director, Division senior staff, and Commission senior staff concerning the Division's Examination program.

The Deputy Director is responsible for policy and management functions to direct the Examination program, staff, and resources.

The Deputy Director is instrumental in assisting the Director in defining, planning, and formulating the mission and goals to ensure programmatic and resource commitment to accomplishing the Division's work.

In addition, the Deputy Director explores and develops ideas, evaluates problems, and implements courses of action in areas, which may involve issues that are unprecedented or where precedent and past practices do not serve emerging needs.

Provides expert advice and technical guidance to the Director, the Commission, and Commission senior staff concerning the examination program for Market Participants and self-regulatory organizations (SROs).

Develops and maintains procedures used to examine and review Market Participants and SROs in assessing their compliance with the Act, Commission regulations, and Division policy statements and interpretations.

Conducts oversight and plans and supervises direct examinations of Market Participants undertaken by the Division to monitor their compliance with the Act and Commission financial and related reporting regulations.

Routine examinations of Market Participants are performed by SROs, however, the Branch may conduct direct examinations of any registrant for cause or conduct direct examinations across several registrants in furtherance of the analysis of a specific issue or practice by registrants.

Oversees the development of operational programs and supervision of the Branch's oversight and examinations of SROs, including the National Futures Association and Chicago Mercantile Exchange.

Such oversight and examinations are designed to evaluate an SRO's performance in executing its examination and financial surveillance programs over member Market Participants for compliance with applicable provisions of the Act, Commission regulations, and staff guidance or interpretations.

Supervises the Branch's overall program for the oversight of applicable financial surveillance activities of Market Participants, including the Branch's work in assessing compliance with regulatory capital requirements.

Participates in the planning and supervises the execution of any on-site investigations and oversees the resolution of issues raised by such reviews.

Ensures and supervises appropriate and timely follow-up investigations of notices received from Market Participants, SROs, and public accountants relating to financial issues.

Presents the position of the Division concerning issues and other matters pertaining to financial examinations and reviews of Market Participants, and issues and other matters pertaining to an SROs execution of its financial surveillance and compliance programs for member Market Participants.

Represents the Division at conferences, seminars, workshops, committees and meetings.

Supervises the research and analysis of problems, issues, trends, and requirements concerning financial compliance and the preparation of analytical reports or recommendations for future actions.

The Deputy Director serves as the alter ego of the Director and provides executive direction and oversight and shares fully in the planning, organizing, directing, controlling, and coordinating the Branch.

Establishes and evaluates the goals, and the progress made toward achieving them, and institutes policies and procedures directed toward improving the efficiency and effectiveness of the Branch.

Determines resource needs and allocates personnel, funding, and material to achieve overall work objectives. Manages the human, financial and material resources of the Branch.

Builds coalitions with other CFTC Directors and maintains effective relationships with regulated industry participants, other agencies, members of Congress and other interested parties.
