Full Job Description

This position is in the Fraud Division, Enforcement Bureau (EB), Federal Communications Commission (FCC) located in Washington, DC. Relocation expenses will not be paid.

Professional law experience is experience that has equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position and is typically in or related to the work of the position to be filled.

Education You must meet the minimum basic educational requirements for Attorney positions. Education requirements include: a professional law degree JD, LL.B., and/or LL.M.

Specialized Experience Applicants must have a minimum of 4 years of professional law experience, including one year of specialized experience which must be equivalent to at least the GS-14 in the Federal service.

For this position, specialized experience includes the following: 1.

Overseeing and/or leading others in analyzing complex legal issues affecting questions of law and fact and rendering opinions on such issues; 2.

Directing and conducting in-depth, complex legal research on authorities and precedents on points of law; 3.

Reviewing and analyzing pleadings and other position papers on controversial and complex issues; 4.

Writing and directing others in writing detailed and complex documents including briefs, issue papers, reports, policy statements, and summaries with recommendations or conclusions; and/or 5.

Providing legal guidance to attorneys and other professionals.

Subject matter experts will review your application to determine if you meet the following required Knowledge, Skills and Abilities (KSA's): Expert knowledge on matters relating to litigation, investigation and fraud.

Ability to supervise, lead or oversee staff performing Attorney related work.

Skill in written and oral expression sufficient to pursue legal issues against opposition which vigorously contests the agency position and usually involve top attorneys in both the private and public sector.

Full mastery of all law, precedents, policy, procedures, rules and legislative proposals related to FCC regulatory enforcement activities, hearings and investigations.

Knowledge of research strategies and techniques to research legal issues where no clearly applicable precedents are available or it is arguable which precedents apply.

You will receive credit for all qualifying experience, including volunteer experience. Major Duties:

The Division Chief leads a team of attorneys, analysts, and staff members responsible for investigating fraud targeting critical FCC-funded and -administered programs, including Universal Service Fund (USF) support and the Secure and Trusted Communications Networks Reimbursement Program (Supply Chain Reimbursement Program).

The incumbent is responsible for supervising and managing a group of professional and paraprofessional staff members in the development and administration of investigative programs to monitor compliance with the Communications Act of 1934, as amended, Commission rules, and policies.

The incumbent provides authoritative legal advice to the Bureau Chief, Deputy Bureau Chiefs, staff and Commission officials on legal matters involving complex issues related to fraud, waste, and abuse of federal programs including USF support and Supply Chain Reimbursement Program.

Assignments include:

conducting discovery, including drafting Letters of Inquiry and subpoenas, reviewing documents, and conducting witness interviews and depositions;

coordinating with investigators and staff within the FCC and other federal agencies;

advising the Bureau Chief and other senior FCC staff about the appropriate handling of cases involving rule violations related to fraud of federal funds; and

drafting memoranda and orders in cases involving rule violations related to fraud perpetrated against federal funds.

The incumbent will keep abreast of major legal developments affecting Bureau and Commission issues and activities through a review of court and Commission decisions, professional publications and trade press and by researching legislation, decisions, opinions, and regulations.
