Full Job Description

The Division of Enforcement is seeking a Senior Officer- Chief of Bankruptcy, Collections, Distributions, and Receivership (BCDR).

This position is located in Washington, DC and is open to current SEC employees in the Division of Enforcement.

You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S.

Department of Education. All qualification requirements must be met by the closing date of this announcement. BASIC REQUIREMENT: All applicants must possess the following J.D. or LL.B.

degree --AND-- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico.

(Note: proof of bar membership will be required before entry on duty.

MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement. SO-01: Applicants must have four year(s) of post J.D.

work experience identifying legal issues, providing legal analyses, recommendations, and preparing complex legal documents, which also includes at least three years of specialized experience.

Specialized experience includes: Interpreting Federal securities laws; and Conducting investigations and enforcement activities under the Federal securities Acts relating to the anti-fraud, anti-manipulative, and other provisions of the Acts.

Major Duties:

The Chief of Bankruptcy, Collections, Distributions, and Receivership (BCDR) will work closely with the Division's Chief Litigation Counsel to oversee the process through which the SEC returns money to harmed investors - through distributions and the work of court-appointed receivers - and collects outstanding monetary judgments both in district court and bankruptcy proceedings.

The BCDR Chief will consult with teams across the Division to determine whether a receivership, a bankruptcy trustee or a distribution is the best mechanism for benefitting investors in any particular Enforcement matter.

Moreover, the BCDR Chief will ensure that the Commission is well represented in court and in administrative proceedings with regard to bankruptcy, collections, distribution, and receivership matters, and that consistent positions are taken and quality representation is consistently provided on a prompt and efficient basis.

Duties: Working closely with the supervisory trial counsels for bankruptcy/receivership, collections and distributions, supervises and directs the Enforcement Division's attorneys in BCDR.

Counsels employees on administrative and technical matters. Assigns work based on program priorities and subordinates' capability.

Evaluates employee performance, resolves employee complaints, and effects disciplinary measures as required. Recommends promotions and reassignments. Conducts all other related supervisory tasks.

Working closely with the supervisory trial counsel for collections, manages the Enforcement Division's Collections program which interfaces with receivers appointed in SEC Enforcement cases, utilizing knowledge and ability in the field of debt collection and federal government collections litigation.

Working closely with the supervisory trial counsel for distributions, manages the Enforcement Division's Distributions Program, and oversees the development of distribution plans to courts of funds obtained by the Commission in its litigation.

Working closely with the supervisory trial counsel for bankruptcy and receiverships, manages bankruptcy investigations and litigation and helps coordinate the positions taken in ongoing bankruptcy proceedings with district court litigation.

Working closely with the supervisory trial counsel for bankruptcy and receiverships, manages the Division's work in connection with seeking the appointment of receivers, as well as monitoring and coordinating with receivers.

Establishes and monitors standards of quality control for the preparation of legal papers and documents used in administrative and court proceedings with regard to bankruptcy, collections, distributions and receiverships.

Manages the appropriate staffing of enforcement matters across the units specializing in collections, distributions and bankruptcy as necessary.

As a member of the top managerial group of the Division, actively participates in meetings involving all aspects of the division's responsibilities.

Makes known his/her own views and opinions as to proposed courses of action and upon assignments by the Chief Litigation Counsel or Director and accepts responsibility for special phases or projects.
