As our Industrial Relations Agent 2 you will have direct impact on fulfilling the “Working” component of the mission by providing education, outreach, consultation, and enforcing compliance with the statutes listed below.

This work elevates awareness and understanding of Washington’s fair labor requirements, processes, and obligations for both employers and employees.

In this role you will assist in managing the development and implementation of RCW 49.60.515 for the Employment Standards Program.

You will also respond to complaints to investigate the sexual harassment and assault policy requirements for certain isolated workers, and other requirements as outlined in the statute.

Requirements

Some of what you’ll do:


  • Facilitate the collection of the following data from property service contractors.
    • The date of adoption of the sexual harassment policy required in RCW49.60.515(1)(a)
    • The number of managers, supervisors, and employees trained as required by RCW 49.60.515(1)(b)
    • The physical address of the work location or locations at which janitorial services are provided by workers of the property services contractor, and for each location: (A) The total number of workers or contractors of the property services contractor who perform janitorial services; and (B) the total hours worked.
  • Ensure the data collected above is available to the public upon request, as required by the law.
  • Screen and investigate complaints from customers who believe they were denied their rights under RCW 49.60.515.
  • Work independently to conduct programmed compliance inspections and investigations.
  • Determine whether or not an employee or applicant was denied any of the protected rights under RCW 49.60.
  • Identify and analyze issues in dispute, recommend solutions, and negotiate settlement or otherwise mediate and resolve disputes between employers and employees.
  • Prepare case files for litigation and testify in judicial proceedings.
  • Work closely with DOSH, IT, and other programs to ensure all department requirements are met under RCW 49.60.515.
  • Serve as a subject matter expert on the requirements of RCW 49.60.515.
  • Work closely with Attorney General’s office to interpret the law.
  • Work closely with management officials of state, federal, city, and county agencies and political subdivisions regarding projects or programs related to State of Washington Employment Standards and Labor Laws.
  • Conduct outreach, education, and training to the public about the requirements of RCW 49.60.515 and other Employment Standards requirements.Upon request or assignment, speak before any group of interested people concerning issues related to RCW 49.60.515.

    Proactively seek out additional opportunities to provide education and outreach.

  • Write and edit publications, reports, pamphlets, or newsletters for internal and external distribution.
  • Work with communication staff in the development and distribution of media campaigns, social media activities, and marketing materials.
  • Legislative Activities
  • Assists in writing rules and policies regarding RCW 49.60.515.
  • Represents the department at legislative hearings (if required)

Qualifications

Required:

  • A combined 5 years’ experience in labor/employment relations and regulations; OR


  • A Bachelor’s degree; AND


  • One year of experience in labor/employment relations and regulations; collection of revenue/taxes from employers/businesses; criminal and administrative investigations; audit of employer financial records; interpretation and explanation of rules and regulations regarding employment law, wages and hours, and child labor laws; or related experience.

OR


  • an Associate's degree AND 3 years or more of experience.


Additional qualifying experience will substitute for education at the rate of one year of experience for one year of education.

  • The ability to take action to learn and grow.
  • The ability to take action to meet the needs of others.


Desired:

Knowledge of laws governing all phases of labor relations, general policies, principles, and practices; of labor and management; state wage and hour laws and regulations; contracts and related labor relations; ability to apply such knowledge to mediation, arbitration, and resolution; principles, standards, and techniques of personal investigations; rules of evidence, auditing, accounting, and bookkeeping procedures.

Understanding of interaction between federal and state statutory schemes concerning employment standards.

  • Ability to interpret complex laws, rules, and regulations; analyze issues involving wage disputes and formulate suggestions for compromise and settlement of disputes; prepare written documents; organize facts, arguments, and conclusions in clear and logical sequence; gather, preserve, and present material, relevant and pertinent evidence; exercise mature judgement in a wide variety of public contact.

  • Ability to testify at legislative hearings, prepare bill analysis, and complete fiscal notes. Ability to testify in court proceedings.

  • Ability to communicate and present complex information in clear, concise, and logical sequence; gather, preserve, and present material, relevant and pertinent evidence; exercise mature judgment in a wide variety of public contacts.

  • Ability to organize and complete special projects; direct the work activity of staff during specialized and complex investigations; prioritize staff workload, monitor workload output; provide on-the-job training; compile complex reports.

    Interpret complex laws, rules, and regulations, analyze issues involving wage disputes and formulate suggestions for compromise and settlement of disputes.

  • Experience investigating complaints or auditing employment records.
