Summary

Full Job Description

Serves as a senior trial attorney and manager, providing program direction and technical leadership in the Sarbanes-Oaxley (SOX) Group, and other areas of litigation handled by the Commission.

All qualification requirements must be met by the closing date of this announcement. Qualifying experience may be obtained in the private or public sector.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional, philanthropic, religious, spiritual, community, student, social).

Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment.

You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S.

BASIC REQUIREMENT: All applicants must possess the following J.D. or LL.B.

degree --AND-- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico.

MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement. SK-17: Applicant must have four years of post J.D.

work experience, identifying legal issues, providing legal analyses, providing legal solutions/recommendations, and preparing legal documents, such as contracts, dispositions, pleadings, and motions, which also includes at least three years: (1) Litigating complex civil or criminal cases in Federal Court or Administrative Proceedings; AND (2) Applying the Federal Rules of Civil Procedure and the Federal Rules of Evidence.

Major Duties:

As an expert in a specialized area of law, conducts and supervises litigation of the most complex SEC cases such as sanctions against well-known entities and individuals; collections and distributions; prosecution of misconduct by attorneys appearing and practicing before the SEC; and bankruptcy and insolvency case Typical Duties Include: Participating with investigative and Trial Unit staff to assess litigation risks and recommend enforcement actions.

Providing advice during investigations on litigation-related issues.

Supervising trial attorneys and litigation in a variety of cases, including difficult and complex matters that can result in new legal precedent.

These cases often are highly sensitive, high-profile, and require innovative litigation and trial techniques.

Supervising, reviewing, and editing all case-related legal papers and briefs filed in assigned litigation cases, including in civil actions and administrative proceedings.

Supervising oral arguments, hearings, and trials in court and attending court proceedings, as warranted. Providing effective leadership in assessing settlements.

Conducting litigation in district court and administrative proceedings, including preparing and filing briefs and other legal papers, arguing motions, taking depositions, and trying cases.

Representing the SEC in dealings with state and federal regulatory and enforcement counterparts.
