The Opportunity

The Department of Health is seeking multiple senior-level Legal Examiner 3’s to support the mission of protecting and improving the health of people in Washington State by delivering high-quality legal services to the Washington State Board of Nursing.

WABON protects the public’s health and safety by regulating licensed practical nurses, registered nurses, advanced registered nurse practitioners, and nursing technicians.

This position manages highly complex, high-profile nursing discipline cases that may involve political sensitivity, significant public scrutiny, or substantial risk to public safety and the agency.

As the senior level in the Legal Examiner series, this role requires advanced legal judgment, deep regulatory knowledge, and the ability to navigate novel and challenging legal issues involving healthcare providers.


Key Responsibilities Include


Case Oversight & Legal Analysis

  • Advise investigators on complex cases involving allegations of unprofessional conduct.
  • Guide evidence collection and conduct thorough legal analysis.
  • Collaborate with criminal prosecutors when appropriate.
  • Manage high-profile and politically sensitive cases involving significant public safety considerations.


Recommendations & Board Advisement

  • Analyze facts and applicable law to recommend appropriate discipline or alternatives to discipline.
  • Present and advise WABON decision-making panels on case outcomes.
  • Provide strategic legal counsel on regulatory enforcement actions.


Legal Research & Drafting

  • Conduct advanced legal research on state and federal statutes, case law, and administrative decisions.
  • Draft pleadings, briefs, memoranda, correspondence, interpretive guidelines, rules, and proposed legislation.


Negotiation & Resolution

  • Negotiate settlements in nursing disciplinary matters, including terms, conditions, and restrictions.
  • Facilitate fair, legally sound resolutions that prioritize public protection.


Leadership & Subject Matter Expertise

  • Serve as a legal resource to WABON staff and board members.
  • Participate in special projects, quality improvement initiatives, and workgroups.
  • Act as subject matter expert in legislative implementation efforts.

Required Qualifications

Option 1: Three (3) years of experience as a member of an administrative tribunal empowered to issue findings of fact and law.

Additional Required - Current active license to practice law in Washington State.

  • Knowledge of agency, board, or commission-specific statutes and rules and related regulations and the case law relating to the statutes and rules (Uniform Disciplinary Act and Washington Administrative Procedure Act).
  • Knowledge of administrative law and procedure (including adjudicative proceedings and rulemaking), the rules of evidence and case law related to admissibility of evidence; civil procedure; constitutional law; public disclosure laws.
  • Graduated in the top 50% of law school class.

Work Setting:

  • The official duty station for this position is home-based. If onsite work is requested by the supervisor, the request will be planned and communicated in advance.
