The WA State Attorney General's Office's Medicaid Fraud & Abuse Division has added a new Managing Assistant Attorney General 1 position. We are seeking a Managing Criminal PROSECUTOR/LITIGATOR to supervise, investigate, prosecute and litigate Medicaid provider fraud as well as abuse and neglect of persons in residential facilities or by a Medicaid provider using the full array of civil and criminal remedies.

The Medicaid Fraud & Abuse Division (MFA) is both a civil and criminal law enforcement division.

MFA is unique in that it involves protecting not only Washington’s Medicaid program of roughly $23.5 billion per annum, but also persons on Medicaid, and all residents of long-term care facilities.

MFA cases are consistently complex and on the cutting edge of legal theories and issues.

The cases range from large scale organized corporate fraudulent activity to single provider fraud or abuse cases.

MFA has a unique team-focused investigative process combining the joint efforts of a team of equals - an attorney, investigator, data scientist, paralegal and clinical investigator.

This, and the great people who make up the division, gives MFA a uniquely terrific team atmosphere.

MFA is comprised of three offices. The main office is in Olympia, and there are branch offices, supervised from Olympia, in Seattle and Spokane.

The position will be located in Olympia, downtown Seattle or Spokane, depending on the needs and interest of the person hired to fill this role.

The AGO provides some flexibility with respect to schedules and telecommuting, consistent with the needs of the Office.

Requirements

This position is a primarily criminal Managing AAG 1 position in MFA’s Olympia, Seattle or Spokane office.

Successful candidates will be highly motivated, have a strong desire to ethically enforce the law and the demonstrated ability to work with a team. This position is part of the MFA Criminal Team.

Unlike a typical Prosecuting office where attorneys become involved in a case later or post investigation, MFA AAGs work on cases from the outset, initial investigation through prosecution.

This position focuses on the investigation and prosecution of companies, organizations, and individuals who defraud the State Medicaid fund as well as person crimes related to the abuse and neglect of vulnerable adults who reside in residential facilities, and the abuse and neglect of Medicaid recipients in connection with the provision of Medicaid services.

The Division focuses on the systemic issues regarding long-term care facilities.

All MFA investigations, civil or criminal, are typically months if not years-long highly complex white-collar fraud/ abuse investigations.

All AAGs in MFA must manage a robust caseload, including coordinating investigations from their outset as part of a team of equals comprised of analysts, special agents, medical specialists and paralegals assessing evidence, and resolving cases through litigation or negotiation.

Attorneys must work with a sense of urgency and take the initiative to keep their cases moving toward resolution.

This position has the opportunity to collaborate on national cases with the National Association of Medicaid Fraud Control Units (NAMFCU).

These investigations come with ongoing specialized training at the local and national level and offers an unparalleled investigative network.

MFA routinely collaborates on investigations with United States Attorney’s Offices and other Medicaid Fraud Control Divisions throughout the country.

Our investigations often include federal counterparts such as the Department of Health and Human Services Office of Inspector General, Federal Bureau of Investigations, U.S.

Customs, as well as local law enforcement, and state administrative agencies.

As a member of the Division and AGO’s management, this Managing AAG position’s duties will also include:

  • Supervising Medicaid Fraud & Abuse criminal prosecution and investigation;
  • Mentoring and coaching attorneys, and their case teams;
  • Listening and communicating effectively both internally and externally;
  • Managing and evaluating the performance of attorneys;
  • Actively participating in division leadership;
  • Development and implementation of operational processes;
  • Lead, oversee and assist with criminal investigations and prosecutions;
  • Deploy resources where they are most needed; and
  • Assist with intake and assessing referrals.

Qualifications

In addition to meeting the qualifications to serve as an Assistant Attorney General, the selected candidate should have:

  • Demonstrated ability to foster teamwork and collaboration and promote a positive work environment that recognizes and respects all employees;
  • Ability to maintain productive working relationships across the division, agency, and with other state agencies and stakeholders;
  • Demonstrated ability to lead and mentor attorneys and professional staff;
  • Strong analytical, research, organizational, and writing skills;
  • Excellent judgment;
  • Experience successfully handling multiple time-sensitive assignments; and
  • Commitment to help create a diverse, equitable, and inclusive workforce and culture that encourages and celebrates difference.

Highly preferred qualifications include:

  • Ten or more years of complex criminal prosecution experience;
  • Familiarity with Washington criminal law;
  • Familiarity with district and superior courts in Washington;
  • Experience managing a team; and
  • Experience working with underrepresented or ethnically diverse communities or groups.

Applicants must have graduated from a law school accredited by the ABA or completed the WSBA's Rule 6 Law Clerk Program and; be licensed to practice law in Washington State. (Applicants who meet the other stated qualifications and are actively pursuing admission will also be considered.) MAAG1 salaries are set between $86,328 and $161,700. The exact amount is set in accordance with Appendix B of the AWAAG CBA.

The salary of an employee whose official duty station is Seattle would reflect an additional 5% King County Assignment Pay per legislative action.
