The Criminal Investigation Division, the enforcement arm of the West Virginia Department of Revenue, State Tax Division, is seeking applicants for a position as an Investigator Associate.

Under general supervision, at the full-performance level, this position will independently conduct investigations of violations of state laws, agency policies, and regulations administered and overseen by the State Tax Division.

Work involves direct public contact as well as contact with business representatives, attorneys, and government officials.

These positions are subject to being in on-call status during non-business hours.

The successful candidate will investigate, inspect, report, and work to obtain evidence of reported fraud and violations of statutes administered and overseen by the State Tax Division while maintaining confidentiality and professionalism. Examples of work include but are not limited to:

  • Complete oral and written reports.
  • Conduct routine inspections of businesses.
  • Investigate tax violations related to cigarettes, motor fuel, soft drinks, consumer sales tax, withholding tax, use tax, business registration, bingo & raffle licenses, and other tax types.
  • Investigate situations of potential non-compliance and complaints made to the agency about delinquent taxpayers.
  • Research and investigate tax fraud using computer aided research using various databases, and courthouse records,
  • Apply laws, regulations and policies to investigate cases.
  • Inspect bills of lading, tax returns, financial documents, and other supporting information in building a case.
  • Conduct field investigations to ascertain facts and obtain evidence on reported violations; obtain statements concerning alleged violations.
  • Explain pertinent laws or other agency regulations as it relates to a suspected violation during the investigation process.
  • Testify in court.
  • Investigate businesses for proper licenses and cite for violations.
  • Keep records and make oral and/or written reports of all investigations.
  • Locate witnesses and obtain facts and evidence needed by attorneys in litigation of cases.
  • Interview subjects of investigation, complainants and witnesses using prescribed procedures.
  • May check business records to determine the amount of taxes due to the state.
  • Complete criminal prosecution reports, issue citations, file criminal complaints, secure warrants, and follow other protocols with the permission of agency leadership, where applicable.
  • May work with tax and revenue auditors, compliance agents, and others as assigned. This position may also be responsible for the service of distress warrants and other documents, as well as the execution of seizures.

Performs related work as required. Travel is required, so a valid driver’s license is required. Position is subject to flexible shift schedules and on-call status.

The successful candidate will have good communication skills with the ability to communicate via email, text message, phone call, and in person.

This position will require attendance at court hearings, tribunal hearings, meetings with attorneys, and providing testimony under oath.

The successful candidate may be called upon to represent the agency as a member of working groups or task forces or to attend information sharing meetings with other stakeholders.

Regular contact with the public at large is extensive.

This is a field-based position, and following training, headquarters will be the employee’s home.

Therefore, the chosen candidate must have suitable office space and the availability of high-speed internet at their home.

A self-starter with the ability to be accountable for their time and whereabouts to the chain of command is a must.

The chosen candidate must be able to learn quickly, apply knowledge obtained, and effectively communicate what he or she has learned to others.

Must be able to work both independently and as a member of a team. May be required to deal with situations that are potentially dangerous.

Employment requires a fingerprint-based criminal-background check to be provided at the West Virginia Tax Division’s expense.

Failing to initiate the process or cooperate with this process, providing false or incomplete information, or discovery of disqualifying information will result in denial of, or dismissal from, employment or denial of transfer irrespective of when discovered.

The chosen applicant will also be subject to a tax compliance check.

Qualifications

Training: Bachelor's degree from an accredited college or university.

OR

Substitution: Additional experience as described below may substitute for the required training at the rate of one (1) year of experience for every thirty (30) semester hours of training.

AND

Experience: One (1) year of full-time or equivalent part-time paid experience in law enforcement or investigative work or in determining eligibility for credit, insurance or government programs.


Special Requirements: Possession of a valid driver's license and the availability of an automobile is required. Qualification to possess and use firearms may be required.
