About Colorado Energy & Carbon Management Commission (ECMC):
The Colorado Energy & Carbon Management Commission (ECMC) regulates the development and production of Colorado's natural resources, including oil and gas, geothermal energy, and carbon capture and storage. The ECMC's mission is to do so in a way that protects the environment, public health, safety, and welfare.

The Enforcement team is tasked with determining Operator compliance with rules adopted by the Colorado Energy and Carbon Management Commission (ECMC) to protect public health, safety, welfare, the environment and wildlife resources. The team includes enforcement advisors, enforcement supervisors, an NOAV Specialist, and the unit manager. The Enforcement team performs the following functions:
1. Initiate enforcement actions when compliance cannot be obtained cooperatively;
2. Negotiate enforcement actions to pursue cooperative settlement;
3. Prosecute contested enforcement actions before Hearing Advisors, ALJs or the Commission;
4. Provide technical knowledge and guidance to the regulated community, ECMC Staff and external
stakeholders;
5. Evaluate and propose new rules and regulations or modifications to existing rules and regulations for
implementation by ECMC; and
6. Provide expert testimony to the Commission or other regulatory agency regarding compliance of oil and
gas facilities with ECMC rules and the Colorado Oil and Gas Act.
7. Represent the ECMC at public outreach events and meetings and conduct stakeholder meetings.

The Enforcement Supervisor is responsible for the efficient and effective management of the ECMC enforcement program.

ECMC’s enforcement program is implemented by Enforcement Advisors and Assistant Attorney Generals (AAGs) assigned to ECMC enforcement efforts.

The Enforcement Supervisor supervises Enforcement Advisors and oversees AAGs (Prosecutors) who work with and advise various operational units (engineering, environmental, compliance, planning and permitting, and finance) regarding enforcement actions within their program areas.

The Enforcement Supervisor also performs Enforcement Advisor functions.


Specific job duties include but are not limited to:

Directly negotiate AOCs (settlement agreements) and prepare settlement documents to resolve enforcement actions in matters where the Attorney General’s Office is not involved.

Present and defend AOCs before a Hearing Officer, ALJ and/or the Commission.

In cases where the Attorney General’s Office is involved, participate in negotiations and assist in document formulation and drafting.

  • Provide policy, technical and legal assistance and guidance to agency staff in the operational units on the proper methods to gather facts, evidence and witnesses as background and evidentiary information for NOAVs, AOCs, and OFVs.
  • Consult with management to provide guidance and direction regarding the application of the enforcement program. Coordinate and prioritize enforcement matters for the ECMC by establishing strategies, systems, processes and guidelines to implement a comprehensive enforcement program.
  • Provides leadership and daily direction/supervision for the ongoing operations of the Enforcement Unit, including direct supervision of three Enforcement Advisors. This position assists the Manager in deciding the processes and procedures necessary to administer all aspects of the Enforcement Unit.
  • Confer with the Attorney General’s Office and ECMC staff to ensure time-sensitive compliance with requests under CORA.

    Draft timely responses and ensure availability of responsive documents to the public. Assist Attorney General’s Office in formulating assertions of privilege and exemption from CORA.

    Coordinate with the Enforcement Manager to develop, and implement, process improvements to the enforcement program.

    This may include, for example, training, preparing process flow documents, determining enforcement priorities, reviewing existing and draft NOAVs, operator outreach regarding systemic or discrete compliance issues, preparing penalty calculations, project managing a warning process with another unit, preparing suggested regulatory and statutory changes that would improve the enforcement process.

    Minimum Qualifications:

    Experience Only:

    Eight (8) years of relevant experience in an occupation related to the work assigned to this position

    OR

    Education and Experience:

    A combination of related education and/or relevant experience in an occupation related to the work assigned equal to eight (8) years

    AND
    Experience and/or education related to reading, writing, interpreting and applying legal documents, regulations, statutes, etc.

    Substitutions:

    Additional appropriate education will substitute for the required experience on a year-for-year basis.

    • Knowledge and/or experience with Colorado oil and gas industry, including current rules and regulations.

    • Knowledge and/or experience with ECMC rules, regulations, and regulatory processes.

    • Law degree from an accredited institution.

    • Excellent legal writing and legal research skills.

    • Professional experience participating in trials and hearings.

    • Demostrable experience in negotiations, including crafting and memorializing settlements.

    • Strong written and verbal communication skills, to include public speaking.

    • Experience managing multiple projects with differing deadlines in order to meet agency needs.

    • Experience negotiating and/or enforcing legal agreements.

    The current work arrangement for this position is as follows:

    • Hybrid: This position will work from a home office with occasional travel to the main Denver office and around the state for meetings and/or hearings as directed by the unit Manager.

    Conditions of Employment:
    • Colorado residency is required at the time of application.
    • This is a Remote/Hybrid position - Work is primarily performed from a home office, however the selected candidate must be willing and able to, at times, report to the office at 1120 Lincoln Street, Suite 801 - Denver, CO or other locations for meetings, training, and projects as directed by the unit Manager.
    • Former employees of the state of Colorado must have concluded employment in good standing to be eligible for rehire.
    • You must be legally eligible to work in the United States to be appointed to this position. DNR does not sponsor non-residents of the United States.
    • Travel to out of town hearings of the ECMC, with the possibility of overnight stays will be required.
    • Must possess and maintain a valid state of Colorado driver's license if operating a State vehicle.
