Full Job Description

HHS OGC seeks a Deputy Associate General Counsel (DAGC) for Program Integrity responsible for leading a team of attorneys advising on issues across Medicare, Medicaid, and the Affordable Care Act, and supports implementation of key initiatives such as the Inflation Reduction Act Drug Price Negotiation Program.

The DAGC is a senior leadership position responsible for directing legal strategy and oversight on some of the government's most complex and high-stakes enforcement and compliance matters.

Candidates should be committed to improving the efficiency of the Federal government, passionate about the ideals of our American republic, and committed to upholding the rule of law and the United States Constitution.

TECHNICAL QUALIFICATIONS (TQs): Your resume should demonstrate accomplishments that would satisfy the technical qualifications.

TQ 1: Substantial practice in healthcare enforcement and program integrity, including in Medicare, Medicaid, and ACA programs, including demonstrated expertise with False Claims Act matters.

Requires strong background in administrative law, statutory and regulatory interpretation.

Experience with emerging healthcare initiatives, including drug pricing or the IRA Drug Price Negotiation Program, is desirable.

TQ 2: Proven leadership experience and excellence directing an effective cadre of regulatory attorneys and supporting personnel, setting appropriate priorities, and ensuring that the organization meets clients' needs for a high functioning group handling a large volume of extremely complex, high priority rulemakings, guidance documents, agency initiatives, and other assignments.

Demonstrated exceptional judgment, communication skills, and commitment to public service is required.

EXECUTIVE CORE QUALIFICATIONS (ECQs): In addition to the Technical Qualification Requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs.

ECQ 3: Merit and Competence - This core qualification involves the demonstrated knowledge, ability and technical competence to effectively and reliably produce work that is of exceptional quality.

ECQ 4: Leading People - This core qualification involves the demonstrated ability to lead and inspire a group toward meeting the organization's vision, mission, and goals, and to drive a high-performance, high-accountability culture.

This includes, when necessary, the ability to lead people through change and to hold individuals accountable.

ECQ 5: Achieving Results - This core qualification involves the demonstrated ability to achieve both individual and organizational results, and to align results to stated goals from superiors.

Note: If you are a member of the SES or have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, you do not need to respond to the ECQs.

Instead, you should attach proof (e.g., SF-50, Certification by OPM's SES Qualifications Review Board (QRB)) of your eligibility for noncompetitive appointment to the SES. Major Duties:

The Deputy Associate General Counsel (DAGC) leads the Program Integrity Branch at the forefront of the government's efforts to combat fraud, waste, and abuse in federal healthcare programs.

In this role, the DAGC directs a high-performing team of attorneys, setting legal strategy and ensuring the delivery of timely, high-quality, and impactful counsel on enforcement, compliance, and oversight across Medicare, Medicaid, and the Affordable Care Act (ACA).

Serving as a principal advisor to CMS and OGC leadership, the DAGC shapes the legal framework for some of the most complex and consequential program integrity issues facing the Department.

This includes guiding the interpretation and application of statutes and regulations, advising on sophisticated enforcement authorities and administrative remedies, and developing program safeguards that protect beneficiaries and taxpayer resources.

The DAGC works closely with the Department of Justice on significant False Claims Act (FCA) matters and other enforcement actions, influencing case strategy, legal theories, and resolution approaches in high-stakes litigation.

The incumbent also collaborates extensively with the HHS Office of Inspector General (OIG) on audits, investigations, and enforcement priorities, ensuring coordinated and effective oversight of federal healthcare programs.
