The South Carolina Judicial Branch is seeking a dedicated and experienced Attorney II to join the Office of Disciplinary Counsel.

Under limited supervision and at the direction of the Disciplinary Counsel, this position plays a critical role in preserving the integrity of the South Carolina judicial system and maintaining public confidence in the administration of justice.

The Attorney II screens and investigates allegations of ethical misconduct or incapacity involving judges and lawyers, prosecutes formal charges, and performs other related duties as assigned.

Essential Duties and Responsibilities of the Position

This job bulletin represents general duties for this position and is not intended to be construed as exclusive or all-inclusive. Other duties may be required and assigned.

  • Receive, screen, and investigate complaints involving alleged ethical misconduct by lawyers or judges in accordance with applicable rules of conduct.
  • Refer complaints to appropriate agencies when necessary.
  • Negotiate and draft agreements for discipline to be submitted to the appropriate Commission.
  • Prosecute formal charges, including:
    • Conducting limited discovery and exchange of information.
    • Presenting cases before the Commission.
    • Drafting and submitting proposed Panel Reports.
    • Reviewing final Panel Reports and preparing exceptions as appropriate.
    • Drafting briefs and presenting oral arguments before the South Carolina Supreme Court
  • Seek interim suspension or appointment of a Receiver when complaints involve potential risk of harm to the public.
  • Maintain accurate and timely case records in Time Matters.
  • Participate in regular case status meetings and work collaboratively with investigators, support staff, and attorneys.
  • Represent the Office at CLE programs, law schools, bar associations, and professional organizations—including preparing and presenting educational materials with prior approval.

Requirements

  • Juris Doctor from an ABA-accredited law school.
  • Admission to or eligibility for admission to the South Carolina Bar.
  • At least three (3) years of legal practice, including:
    • Screening cases, client meetings, witness interviews, drafting pleadings and discovery, and courtroom or administrative appearances.
  • Familiarity with:
    • South Carolina Rules of Professional Conduct
    • Code of Judicial Conduct
    • Law office management practices.
  • Proficiency in Microsoft Office Suite.

Required Knowledge, Skills, Abilities and Other Characteristics

  • Knowledge of state laws and rules of procedure, including SC Rules of Professional Conduct and Code of Judicial Conduct.
  • Knowledge of investigative methods and procedures.
  • Proficiency in standard software applications, including Microsoft Word, Excel, Outlook, PowerPoint, and Time Matters.
  • Strong analytical skills, with the ability to apply disciplinary rules and standards to facts and evidence.
  • Excellent written and oral communication skills.
  • Ability to manage multiple priorities, work independently, and exercise sound judgment.
  • Proficiency in legal research, SC Rules of Evidence, and SC Rules of Civil and Appellate Procedure.
  • Professionalism and discretion when dealing with sensitive or complex matters involving judges, attorneys, or the public.
  • Timely and accurate data entry in Time Matters.
  • Participation in meetings, training, and continuing education as required.
  • Ability to work independently in a fast-paced legal environment.
  • Must be able to lift and carry up to 20 pounds.
  • May involve some standing, walking, stooping, kneeling, or light physical activity.
  • Occasional travel may be required.

Qualifications

  • Appellate practice experience, including:
    • Familiarity with SC Appellate Court Rules.
    • Legal research and brief or motion drafting.
    • Oral argument before appellate courts.
  • Proficiency in electronic case management systems.
