Job Description

Summary

This job involves advising senior officials at the Department of State on legal matters related to the Freedom of Information Act (FOIA) and the Privacy Act, including managing litigation and ensuring compliance with these laws.

A good fit would be an experienced attorney with a strong background in civil litigation and federal government legal issues, who enjoys working on complex cases with less supervision at higher levels.

It's ideal for someone detail-oriented and collaborative, ready to handle policy development and court negotiations.

Key Requirements

  • J.D. or LL.M. from an accredited law school
  • Active membership in good standing with any U.S. state, territory, D.C., or Puerto Rico bar
  • For GS-14: At least three years of post-bar specialized experience, including one year at GS-13 level, with complex civil litigation (e.g., drafting motions, document production, settlements) and FOIA interpretation/application/compliance
  • For GS-15: At least four years of post-bar specialized experience, including one year at GS-14 level, adding experience with federal government operational legal issues
  • Ability to manage FOIA and Privacy Act litigation dockets and develop compliance policies
  • Skills in drafting court filings, negotiating with plaintiffs, and collaborating on strategic litigation approaches
  • No education substitutes for required specialized experience

Full Job Description

This position is located in the Office of the Legal Adviser.

You will serve as an Attorney Adviser and be responsible for providing legal advice and services to senior officials on issues related to the Freedom of Information Act (FOIA) and the Privacy Act in the federal sector.

This position is in the Excepted Service and appointments are made without regard to the legal requirements of the Competitive Service, Executive order, or OPM regulations.

All qualification requirements must be met by the closing date of this announcement.

Applicants applying for this position must meet the following requirements to be eligible for further consideration: Law Degree: Applicants must be a graduate of an accredited law school with a J.D.

or LL.M. Bar Membership: Applicants must be a current member of a bar in good standing in any state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Applicants interested in GS-14: Experience: Applicants must have at least three years of specialized experience with at least one year equivalent to the GS-13 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position.

The specialized experience must have been gained after admission to the bar.

Qualifying specialized experience must demonstrate the following: Experience with complex civil litigation, including drafting motions, preparing documents for production, and/or engaging in settlement discussions; AND Experience with interpretation, application, or compliance with the Freedom of Information Act.

There is no substitute of education for specialized experience for the GS-14 position.

Applicants interested in GS-15: Experience: Applicants must have at least four years of specialized experience with at least one year equivalent to the GS-14 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position.

The specialized experience must have been gained after admission to the bar.

Qualifying specialized experience must demonstrate the following: Experience with aspects of complex civil litigation, including drafting motions, preparing documents for production, and/or engaging in settlement discussions; Experience with interpretation, application, or compliance with the Freedom of Information Act; AND Experience with legal issues arising out of the operations of the federal government.

There is no substitute of education for specialized experience for the GS-15 position. Major Duties:

  • Assisting Department clients and leadership with developing, implementing, and complying with policies and procedures to ensure effective management of the FOIA compliance and litigation programs
  • Manage civil FOIA and Privacy Act litigation dockets.
  • Collaborate with other attorneys and paralegals to develop strategic approaches to FOIA litigation across the office.
  • Draft and review filings for federal district court FOIA litigation, assist in negotiations with plaintiffs and review and production of documents to meet court-ordered deadlines
  • At the GS-15 level, the incumbent performs the same duties as outlined above; however, the scope and complexity of assignments are increased, and the incumbent receives less supervision than the GS-14.
