Job Description

Summary

This job involves providing legal advice to high-level officials in the State Department on handling requests for government information under the Freedom of Information Act (FOIA) and protecting personal privacy under the Privacy Act, including managing related lawsuits.

A good fit would be a licensed attorney with experience in civil litigation who enjoys working on policy development, team collaboration, and court negotiations in a fast-paced federal environment.

Key Requirements

  • J.D. or LL.M. from an accredited law school
  • Active membership in good standing with the bar of any U.S. state, territory, D.C., or Puerto Rico
  • For GS-12: At least one year of specialized experience equivalent to GS-11 in federal service, including civil litigation aspects, gained after bar admission
  • For GS-13: At least two years of specialized experience, with one year equivalent to GS-12, including complex civil litigation such as drafting motions, document production, and settlement discussions, gained after bar admission
  • Ability to assist in developing and implementing FOIA and Privacy Act policies and procedures

  • Collaboration skills with attorneys, paralegals, and DOJ on litigation strategies and court filings

Full Job Description

This position is located in the Office of the Legal Adviser.

You will serve as an Attorney Adviser and be responsible for providing legal advice and services to senior officials on issues related to the Freedom of Information Act (FOIA) and the Privacy Act in the federal sector.

This position is in the Excepted Service and appointments are made without regard to the legal requirements of the Competitive Service, Executive order, or OPM regulations.

All qualification requirements must be met by the closing date of this announcement.

Applicants apply for this position must meet the following requirements to be eligible for further consideration: Law Degree: Applicants must be a graduate of an accredited law school with a J.D.

or LL.M. Bar Membership: Applicants must be a current member of a bar in good standing in any state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Applicants interested in GS-12: Experience: Applicants must have at least one year of specialized experience equivalent to the GS-11 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position.

The specialized experience must have been gained after admission to the bar. Qualifying specialized experience must demonstrate the following: Experience with aspects of civil litigation.

There is no substitute of education for specialized experience for the GS-12 position.

Applicants interested in GS-13: Experience: Applicants must have at least two years of specialized experience with at least one year equivalent to the GS-12 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position.

Qualifying specialized experience must demonstrate the following: Experience with complex civil litigation, including drafting motions, preparing documents for production, and/or engaging in settlement discussions.

There is no substitute of education for specialized experience for the GS-13 position. Major Duties:

  • Assisting department clients and leadership with developing, implementing, and complying with policies and procedures to ensure effective management of the FOIA compliance and litigation programs.
  • Manage civil FOIA and Privacy Act litigation.
  • Collaborate with other attorneys and paralegals to develop strategic approaches to FOIA litigation across the office.
  • Work closely with Department of Justice (DOJ) to draft and review filings for federal court FOIA litigation, assist in negotiations with plaintiffs, review and produce documents to meet court-ordered or negotiated deadlines.
  • At the GS-13 level, the incumbent performs the same duties as outlined above; however, the scope and complexity of assignments are increased, and the incumbent receives less supervision than the GS-12.
