Summary

This role involves serving as an administrative law judge on the State Personnel Board, where you'll preside over appeals from state employees facing disciplinary actions, pay issues, or discrimination claims, ensuring fair hearings and decisions based on Colorado laws.

It's a part-time position (32 hours per week) that can be hybrid but requires occasional on-site work in Denver.

Ideal candidates are experienced legal professionals with a strong sense of fairness, knowledge of employment law, and the ability to handle sensitive cases impartially.

The State Personnel Board (“Board”) is an independent, constitutional entity created by Art. XII, Sec. 14(1) of the Colorado Constitution.

Pursuant to Article XII, Section 14(3), the Board promulgates rules governing the state personnel system.

Pursuant to Article XII, Section 13(8), the Board hears appeals by certified state employees of disciplinary actions.

Pursuant to Section 24-50-125(5) of the Colorado Revised Statutes, the Board also hears appeals by certified state employees of adverse actions that affect base pay, status, or tenure.

The Board may also use its discretion to grant a hearing when it appears that: (A) an employment action violates the Colorado Anti-Discrimination Act (commonly referred to as “CADA”); (B) an employment action violates the State Employee Protection Act (commonly referred to as the "Whistleblower Act"); (C) a final grievance decision violates an employee’s rights under the federal or state constitutions; (D) a final grievance decision violates an employee's rights under the grievance procedures; (E) a final decision of the State Personnel Director violates a rule or statute relating to the comparative analysis process; or (F) a final decision of the State Personnel Director on a matter involving the overall administration of the state personnel system is arbitrary, capricious or contrary to rule or law.The Board consists of five members, two elected by certified state employees and three appointed by the Governor.

The Colorado State Personnel Board (SPB) establishes rules governing the state personnel system and reviews appeals by employees regarding adverse actions that affect their base pay, status, or tenure. The Board may also use its discretion to hear other matters within its jurisdiction.

This position exists to decide appeals (mandatory or discretionary) filed with the Board by reviewing legal documents, ruling on motions, conducting evidentiary hearings, resolving evidentiary issues, making factual findings, applying appropriate legal principles and precedent, issuing formal decisions pursuant to governing law, and facilitating settlement conferences.

A summary of the duties and responsibilities will include, but are not limited to, the following:


Legal Documents / Pleadings Review: Review legal documents and pleadings to determine relevant issues presented in a case by applying legal theories; conducts legal research on legal issues and theories presented.

Legal Rulings: Issues legal rulings on motions by applying provisions of constitutional, statutory, administrative and case law; conducts legal research as necessary in issuing rulings.

Evidentiary Hearings: Conducts evidentiary hearings by taking sworn testimony of witnesses, ruling on evidentiary and legal objections to testimony and admissibility of exhibits, determines appropriate burdens of proof, and decides relevant legal issues; undertakes legal research on evidentiary and legal issues as required.

Written Decisions: Issues written decisions containing factual findings from evidence presented at hearing; conclusions of law based on legal principles and application of provisions of constitutional, statutory, administrative and case law to the factual findings, and recommendations as to the appropriate disposition of the case. Conducts legal research on issues, theories and principles as required.

Discretionary Hearing Review: Reviews petitions for discretionary hearings and issues preliminary recommendations on whether a hearing should be granted or denied based on the issues and facts presented. Researches legal issues and principles presented.

Settlements and other duties as assigned: Serves as a neutral facilitator for cases before the Board. Arranges and conducts settlement conferences; guides parties to mutually approved settlement agreement.

Minimum Qualifications:

Education/Licensure/Certification/Experience:
  • Graduation from an accredited law school
  • Five (5) years of experience practicing law (legal experience acquired after admission to the bar)
  • Active license to practice law in the State of Colorado
  • No substitutions

The exceptional candidate will possess the proven ability or accomplishment in the following preferred qualifications:

  • Previous State Service related to the work assigned to the position
  • Prior experience adjudicating as an administrative law judge, hearing officer, magistrate or municipal/county judge.
  • Prior experience in employment law and/or administrative law.

Conditions of Employment:
  • A pre-employment criminal background check will be conducted as part of the selection process.
  • Active license to practice law in the State of Colorado

Appeal Rights:

An applicant who has been removed from an employment list or removed from consideration during the selection process may request a review by the State Personnel Director.


As an applicant directly affected by the results of the selection or comparative analysis process, you may file a written appeal with the State Personnel Director.

Review of the completed, signed and submitted appeal will be timely on the basis of written material submitted by you, using the official appeal form signed by you or your representative.

This form must be completed and delivered to the State Personnel Board by email at dpa_state.personnelboard@state.co.us within ten (10) calendar days from your receipt of notice or acknowledgement of the Department’s action.
